| Abstract | ||||
| من النوازل المهمة التي ثارت في بلاد عديدة وترتب عليها مشكلات دينية واجتماعية خطيرة ما يعرف بتيسير الموت للمريض، وهي فكرة ظهرت قديما، وانتشرت في بلاد الغرب النفعية التي تقوم على المادة، ولا تصبر على البلاء، ويجزع أهلها من أي ضر يمسهم، ثم انتقلت في غفلة إلى كثير من بلاد المسلمين، فأصبح المريض وأهله لا يصبرون على البلاء، ويجنحون إلى إنهاء ما يظنونه مشكلة في أقرب وقت، فيعمد الواحد منهم إلى الاتفاق مع الطبيب لإنهاء حياته تخليصا له من العذاب والألم، أو يكون ذلك باتفاق بعض الأهل معه، أو بفعل من الطبيب بدعوى رحمته بالمريض وشفقته عليه ورغبته في تخليصه من آلامه وكأنه أكثر رحمة وشفقة من الخالق الذي ابتلى بالمرض، وهنا يتبادر السؤال حول حكم هذه الحالة، وما يترتب عليها من ضمان، فقد يقوم الطبيب بفعل ذلك بنفسه، أو يقوم المريض نفسه بطلب ذلك، ويبيحه قتله وإراحته من ألمه، أو يكون الأمر عن طريق أهل المريض، أيا ما كان الغرض من ذلك، رغبة في راحته بدعوى الشفقة والرحمة، أو رغبة في تعجل موته لصعوبة النفقة على مرضه، حسب البلد الذي تظهر فيه الواقعة فالأمر لا يختص ببلد مسلم بعينه كما ذكرت، ولكنها قضية ظهرت في عديد من بلاد المسلمين والفقه الإسلامي لا يحكم بلدًا بعينه، بل هو عالمي النشأة والحكم، وقد تناولت هذه المسائل في تمهيد ومبحثين وخاتمة ثم فهرس للمراجع. One of the significant contemporary issues that has emerged in several countries and resulted in serious religious and social problems is what is known as facilitating the death of a patient. It is an idea that originated long ago and spread in materialistic Western countries that are driven by utility, lack patience in the face of hardship, and whose people are distressed by any harm that befalls them. This notion then, unfortunately, found its way into many Muslim countries, where patients and their families began to lack patience during trials, leaning toward ending what they perceive as a problem as quickly as possible. As a result, some may resort to agreeing with a doctor to end the patient’s life to relieve them from pain and suffering. This might occur through an agreement with some family members, or it may be done by the doctor under the claim of mercy and compassion, wishing to spare the patient from pain-as if he is more merciful than the Creator who decreed the illness. This raises the question about the ruling on such actions and the liability that results. The doctor may perform the act himself, or the patient may request it and permit his own killing to be relieved from pain, or it may be initiated by the patient’s family. Regardless of the motivation-be it out of mercy and compassion or a desire to hasten death due to the high cost of care-the issue varies depending on the country where it occurs. However, it is not limited to a specific Muslim country. As mentioned, this issue has arisen in many Muslim nations, and Islamic jurisprudence does not pertain to a single country; rather, it is global in origin and application. This study discusses these issues in an introduction, two main sections, a conclusion, and a bibliography. | ||||
