| Abstract | ||||
| الملخـص: إن الله ´ عندما يقدر نشوء الحمل في رحم المرأة فيعني هذا وجوده وأن الرحم يحمل بداخله من قدر له الوجود؛ لذا يحرم التجرؤ بالتعدي عليه، وشرع الله لهذا عقوبتين دنياوية وأخروية بإنهاء حياة من قدر الله له الوجود في رحم المرأة، ففي الوقت الحالي ومع وجود التساهل في إجهاض الأجنة قبل وبعد نفخ الروح لأسباب غير شرعية ومعتبرة كان لابد من إبراز هذا الجانب موضحة فيه أيضا العقوبة المقدرة "غرة الجنين"، من ناحية إبرازها و تقديرها من القديم إلى الحديث عرض فقهي تأصيلي، ويهدف البحث: إلى بيان الإجهاض وأسبابه وبيان حكمه قبل نفخ الروح وبعده، وبيان العقوبة المقدرة "الغرة" من حيث مشروعيتها والأصل الذي تخرج منه، والأصل الذي تخرج عليه، وكونها بين التقدير والتقويم، ويهدف أيضا بيان تقدير غرة الجنين من القديم إلى الحديث، وما عليه العمل والفتوى في تقدير غرة الجنين في الوقت الحالي، وقد اعتمدت في البحث على المناهج: التحليلي، والتوصيفي، والمقارن، ومن أهم نتائج البحث: حرمة إجهاض الجنين مطلقا وإيجاب العقوبة الغرة سواء كان قبل نفخ الروح أو بعده، تقدير غرة الجنين من الذهب أو الفضة، ومراعاة الزمن والواقع المعاصر، وما عليه الفتوى في إخراج القيمة منهما، ومن أهم التوصيات: أوصي أن يكون هناك توعية وتشديد في أمر الإجهاض ولا يجوز إلا في حال لو كان الحمل به يؤدي الى وفاة الأم ويكون بتقرير عدد من الأطباء كما أوصى أن تقوم القنوات التلفزيونية ومنصات السوشيال ميديا التي لها دور فعال في المجتمع وتأثيرها بتبيين خطورة جريمة الإجهاض والحرمة فيه. Abstract: When Allah (SWT) decrees the inception of pregnancy in a woman's womb، it signifies the existence of a being destined for life. Therefore، it is prohibited to transgress this divine decision. Islam has prescribed both worldly and otherworldly punishments for ending the life of a being ordained by Allah to exist within a woman’s womb. Currently، with the growing leniency towards abortion before and after the ensoulment of the fetus for unjustifiable reasons، it is necessary to address this issue and highlight the "ghurrat al-janin" (compensation for the fetus) in both its classical and contemporary interpretations. This research seeks to clarify the causes of abortion، the ruling of abortion before and after ensoulment، the legitimacy of "ghurrat al-janin، " its origins، and the principles from which it arises. Additionally، the study aims to compare the determination of "ghurrat al-janin" from traditional to modern perspectives، and the current fatwa on how to assess the compensation. The methodology used includes analytical، descriptive، and comparative approaches. The key findings of this research include: Abortion is impermissible in all cases، and the compensation (ghurrat) must be paid regardless of whether it occurs before or after ensoulment. The compensation is determined based on gold or silver، considering the time and modern circumstances. The fatwa on the amount to be paid is derived from this framework. The study also provides several recommendations، including: Raising awareness and enforcing stricter regulations on abortion، permitting it only in cases where the pregnancy endangers the mother’s life، confirmed by a panel of doctors. Encouraging media platforms، especially television channels and social media، to highlight the gravity and impermissibility of abortion، emphasizing its prohibition and harmful effects. | ||||
