| Abstract | ||||
| هذا البحث عبارة عن مخطوط قُمْت بدراسته وتحقيقه وقد أُلف في القرن الثاني عشر، وموضوعه مسألة أصولية وهي: "دخول الغاية في المغيّا " للإمام أبي الفلاح، خليل أفندي الآيديني الشَّهير بقرة خليل (ت1123هـ). ويهدف التحقيق إلى إبراز جهود علماء الحنفية في المسائل الأصولية، وطريقة تناولهم لمثل هذه المسائل. وقد حرر المصنف قول صدر الشريعة، وحقق الخلاف، وبين أسبابه بالدليل النقلي والعقلي، محكّمًا المنهج الأصوليّ وقواعده. كما تتضح أهمية البحث من خلال القيمة العلمية والفقهية، فموضوعها أصولي يرتبط بمسألة فقهية، وفي كتاب من الكتب المشهورة عند الحنفية وهو كتاب شرح الوقاية، وعليه اعتماد المتأخرين من الحنفية ، كما أن تحرير المصنف للمسألة الأًولية، بذكر الخلاف، أسبابه، وعزو الأقوال إلى قائليها، واستدلاله بالدليل النقلي والعقلي، وتطرقه إلى الأصول والقواعد، محكّمًا المنهج الأصوليّ، بالإضافة إلى رغبتي في تحقيق المخطوط منذ خوضي لذلك في مرحلة الدكتوراة. وقد اشتمل البحث على مقدمة: تضمنت أهمية الموضوع، وسبب اختياره، وخطة الدراسة والتحقيق، والمنهج فيهما ، وقد قسمته إلى قسمين: الأول: الدراسة وتضمنت التعريف بمُصنِّف الشرح، ودراسته؛ للتعرف على منهج المؤلف، ومصادر هذا المخطوط، والتعريف بكتاب الوقاية ومصنفه. والثاني: التحقيق واشتمل على النَّص المحقق. وفي ختام البحث توصلت إلى أهمية كتاب الوقاية؛ لأنه شرح لكتاب الهداية وهو من أهم الكتب الفقهية عند الحنفية، وأن مسألة دخول الغاية تحت المغيا تعد من المسائل الأصولية المهمة؛ لآثارها التطبيقية في الفروع الفقهية، وإبراز جهود علماء الحنفية في تحقيق المسائل الأصولية، والاهتمام بتحقيق المخطوطات فهي كنز لعقول العلماء- رحمهم الله تعالى. This research is a manuscript that I studied and verified. It was composed in the twelfth century and addresses a fundamentalist issue: "The Inclusion of the Goal in the Purpose" by Imam Abu al-Falah Khalil Efendi al-Aydini, known as Baqara Khalil (d. 1123 AH). The investigation aims to highlight the efforts of Hanafi scholars in fundamentalist issues and their approach to such matters. The author has clarified Sadr al-Shari'ah's statement, investigated the disagreement, and explained its causes with textual and rational evidence, adhering to the fundamentalist methodology and its rules. The importance of the research is also evident in its scientific and jurisprudential value. Its subject is a jurisprudential issue related to a well-known Hanafi book, Sharh al-Wiqayah, which is relied upon by later Hanafi scholars. Furthermore, the author's elucidation of the initial issue, including the disagreement and its reasons, attributing opinions to their proponents, and his use of textual and rational evidence, and his discussion of fundamental principles and rules, emphasizing the jurisprudential approach, is also evident in my desire to authenticate the manuscript since embarking on this task during my doctoral studies. The research included an introduction, which included the importance of the topic, the reason for choosing it, the study and investigation plan, and the methodology used. I divided it into two sections: the first, the study, which included an introduction to the author of the commentary and his study; to understand the author's methodology, the sources of this manuscript, and an introduction to the book al-Wiqayah and its author. The second, the investigation, which included the authenticated text. At the conclusion of the research, I concluded that the book al-Wiqayah is important; Because it is a commentary on the book Al-Hidayah, one of the most important books of jurisprudence among the Hanafi school, the issue of the inclusion of the goal under the meaning of the word is considered an important issue of jurisprudence, due to its practical implications for branches of jurisprudence. It highlights the efforts of Hanafi scholars in investigating the meaning of the word, and emphasizes the importance of authenticating manuscripts, which are a treasure trove for the minds of scholars—may God have mercy on them. | ||||
