| Abstract | ||
| ممَّا لا شك فيه أنَّ استخدام أنظمة الذَّكاء الاصطناعي في مراحل الإجراءات الجِنَائية التي تمر بها الدعوى الجنائية، أدَّى إلى ظهور العديد من التحدِّيات والإشكاليات القانونية الإجرائية نتيجة استخدام الخَوارِزميات القضائية في مجال العدالة الجِنَائية. الأمر الذي يثير معه العديد من التساؤلات القانونية حول ما مدى ملاءمة التشريعات الجِنَائية الإجرائية الحالية لاستخدامات أنظمة الذَّكاء الاصطناعي في مجال مكافحة الجريمة؟، أما نحن في حاجة إلى تحديث القواعد القانونية التقليدية للإجراءات الجِنَائية لتتوافق مع استخدامات تقنيات وحلول أنظمة الذَّكاء الاصطناعي في مجال العدالة؟، ولذلك سوف نستعرض في هذا البحث تحدِّيات الاعتماد على الأدِلَّة المستمدة من أنظمة الذَّكاء الاصطناعي، تم سنتناول بعد ذلك تحدِّيات استخدام أنظمة الذَّكاء الاصطناعي على ضمانات المحاكمة العادلة. Undoubtedly, the use of artificial intelligence systems in the criminal proceedings has led to numerous legal and procedural challenges and problems resulting from the use of judicial algorithms in the field of criminal justice. This raises numerous legal questions about the suitability of current procedural criminal legislation for the use of artificial intelligence systems in the field of crime control. Do we not need to update the traditional legal rules of criminal procedure to be compatible with the use of artificial intelligence technologies and solutions in the field of justice? Therefore, in this research, we will review the challenges of relying on evidence derived from artificial intelligence systems. We will then address the challenges of using artificial intelligence systems to ensure fair trial guarantees. | ||
