| Abstract | ||||
| إن بيع الحق المتنازع عليه هو بيع الادعاء بالحق العيني أو الشخصي، أو بيع المركز القانوني، أو بيع الخصومة، لا المال ذاته، وقد أفردته بالبحث لعدم وجود دراسة مستقلة بشأنه في القانون المدني المصري والفقه الإسلامي، وللخلاف الذي أثير حول مشروعيته، إذ يرى البعض أنه من بيوع الغرر والقمار؛ وقد جاء البحث وفق المنهج التحليلي النقدي المقارن لنصوص القانون المدني وآراء الفقهاء الشريعة والقانون؛ ويراعى أن تسمية هذه المعاملة بيعا قصد بها مطلق المبادلة، لا خصوصية المبادلة بالنقود، ولا المبادلة بالثمن المساوي لقيمة المبيع؛ فقد يتم التنازل عن الحق المتنازع فيه مقايضة، أو بأقل من ثمنه على سبيل الصلح؛ وقد يتم التنازل على جهة المقاصة أو الحوالة، وأيا ما كانت الطريقة التي تتم بها هذه المعاملة فإنها تقوم على أركان هي: المتنازل، والمتنازل له، والمتنازل ضده، ومحل التنازل، والمقابل. وأقرب الأفكار إلى تلك الصورة ما أورده فقهاء الشريعة الإسلامية في أبواب الصلح، حال حديثهم عن تصالح الأجنبي مع المدعى بإذن المدعى عليه أو بغير إذنه؛ ويشترط القانون المدني لصحة بيع الحقوق المتنازع عليها: وجود نزاع بين المتداعيين على عين أو دين، سواء أرفعت دعوى في موضوع الحق، أم لم ترفع. وأن يكون نزول المدعي للأجنبي بمقابل نقدي أو غير نقدي. وألا يخالف بيع الحقوق المتنازع عليها النظام العام؛ وقد منع القانون القضاة، وأعضاء النيابة، والمحامين، وكتبة المحاكم، والمحضرين، من شراء هذه الحقوق سواء بأسمائهم أو بأسماء مستعارة إذا كان النظر في النزاع يدخل في اختصاص المحكمة التي يباشرون أعمالهم في دائرتها، وإلا كان البيع باطلاً. ويقرر الفقه القانوني أن التنازل عن الحق المتنازع فيه إلى أجنبي يرتب أثرين قانونيين لصالح المتنازل ضده هما الإسقاط أو التخلص من المطالبة والاسترداد، كما أورد القانون موانع الاسترداد؛ وقد توصلت في النهاية إلى أن الموضع المناسب لهذه المعاملة هو إيرادها في الفصل المخصص للصلح في القانون المدني. كما أرى أن يعمم المنع من التعامل على هذه الحقوق ليشمل كل تصرف شراء أو غيره؛ وسواء أكان النزاع داخلا في اختصاص المحكمة أو خارجا عنه؛ مع ضرورة التفريق بين التخلص من المطالبة والاسترداد. The sale of the disputed right is the sale of the claim of the right in kind or personal, or the sale of legal status, or the sale of litigation, not the money itself, and I have singled it out in research because there is no independent study on it in the Egyptian civil law and Islamic jurisprudence, and the dispute that has been raised about its legitimacy, as some believe that it is the sale of gharar and gambling; The specificity of exchanging money, nor exchanging for a price equal to the value of the sale, may be waived the disputed right by barter, or less than its price by way of conciliation, and may be waived to the clearing or transfer party, and whatever the way in which this transaction is carried out, it is based on the following elements: the assignee, the assignee, and the assignee, and the place of waiver, and the return. The closest ideas to that picture are what Islamic jurists have mentioned in the chapters on reconciliation, when they talk about the foreigner's reconciliation with the defendant with or without the defendant's permission. The plaintiff's descent to the foreigner shall be in return for cash or non-cash. The sale of disputed rights shall not contravene public order; the law prohibits judges, prosecutors, lawyers, court clerks and bailiffs from purchasing these rights, whether in their own names or under pseudonyms, if the consideration of the dispute falls within the jurisdiction of the court in whose district they carry out their business, otherwise the sale shall be null and void. Jurisprudence establishes that the assignment of a disputed right to an alien has two legal effects in favour of the assignee, namely forfeiture or disposal of the claim and restitution. I also believe that the prohibition from dealing with these rights should be generalized to include every act Purchase or otherwise, whether the dispute is within the jurisdiction of the court or outside it, with the need to differentiate between the disposal of the claim and recovery. | ||||
