| Abstract | ||||
| تناولت في البحث ولاية القضاء في الدولة في ضوء دستور 2014م ووفقًا لأحدث تعديلات قانون المرافعات دراسة مقارنة بالفقه الإسلامي، حيث تباشر الدولة ولاية القضاء عن طريق تنظيم جهات قضائية يتم إنشاؤها وفقًا للدستور , وتختص كل جهة بنصيب من الولاية , وقد اعتمد المشرع نظام تعدد جهات القضاء المصري، وإزاء اختلاف طبيعة النزاعات المطروحة أمام القضاء وزع المقنن المصري القضاء إلى جهتين كبيرتين (جهة القضاء العادي - جهة القضاء الإداري) ؛ ولما كانت هذه النزاعات تتفاوت وتختلف من جهة إلى أخرى فقد عمد المقنن إلى توزيع الجهة الواحدة إلى طبقات من المحاكم على أساس اختلاف الدعوى، وقد يرى المشرع ضرورة إسناد الاختصاص القضائي في نظر منازعات ذات طبيعة خاصة أو كونها متعلقة بفئة معينة من الأشخاص إلى جهات أخرى بجانب الجهتين السابقتين ويمنحها ولاية قضائية ومستقلة بنظر منازعات معينة سواء من حيث الإجراءات المتبعة أمامها والتي تختلف عن إجراءات القضاء صاحب الولاية العامة , وتكون أحكامها في حدود ولايتها ذات طبيعة خاصة، وبموجب دستور 2014م عمل المشرع على ضرورة وجود جهات قضائية بجانب جهتي القضاء (العادي - الإداري) وعمد إليها الاختصاص ومنحها ولاية قضائية محددة بأشخاص معينة , وبمنازعات تختلف طبيعتها عن طبيعة المنازعة أمام القضاء صاحب الولاية العامة، وبجانب الجهات الأربع أنشأ المشرع هيئات ولجان استثنائية وأطلق عليها القضاء الاستثنائي ومنحها الحكم القضائي لاعتبارات تتعلق بالصالح العام، وإعمالاً لتوزيع ولاية القضاء بين الجهات المختلفة يقوم المشرع بتوزيع ولاية كل جهة على محاكمها المختلفة وفقًا لقواعد محددة، وضمانًا لأداء العدالة تباشر الدولة القضاء على كل من هو موجود على إقليمها عن طريق القضاء الوطني , فولاية القضاء وإن كانت إقليمية في الأصل إلا أن المشرع لاعتبارات خاصة يجعلها شخصية كما يخرج عن الخضوع لولاية القضاء بعض الدعاوى نظرًا لطبيعتها وطبيعة المخاطبين بها من ولاية القضاء الوطني، تمارس الدولة ولايتها القضائية على كل من يوجد على أرضها وعلى ما يقع على أرضها من جرائم ووقائع باعتبار أن ولاية القضاء مظهرًا من مظاهر السيادة، وبالتالي تتحدد ولاية القضاء في الدولة بحدود سيادتها، وقد تنتفي عن القضاء الوطني الولاية بعمومها لاعتبارات متعددة لكون النزاع ذات عنصر أجنبي أو متعلقا بعمل من أعمال السيادة أو بشخص يتمتع بالحصانة القضائية، وإذا كان القضاء المدني صاحب ولاية عامة إلا أنه ليس هو جهة القضاء في الدولة وإنما يشاركه جهات أخرى وبالتالي قد تخرج مسائل مدنية يسندها المشرع لجهات أخرى وبالتالي ما يدخل في ولاية هذه الجهات يخرج بالضرورة عن ولاية القضاء المدني. In the research, the jurisdiction of the judiciary in the state in the light of the 2014 constitution and according to the latest amendments to the Code of Procedure, a comparative study of Islamic jurisprudence, where the state undertakes the jurisdiction of the judiciary by organizing judicial bodies that are established in accordance with the constitution, and each party is concerned with a share of the state, and the legislator has adopted the system of multiple bodies of the Egyptian judiciary, and in view of the different nature of the disputes before the judiciary, the Egyptian codifier distributed the judiciary to two large bodies (the ordinary judiciary - the administrative judiciary); The legislator may see the need to assign jurisdiction in the consideration of disputes of a special nature or being related to a certain category of persons to other parties besides the two sides The previous two and gives it judicial and independent jurisdiction to consider certain disputes, both in terms of the procedures followed before it, which differ from the procedures of the judiciary with a general mandate, and its provisions within the limits of its jurisdiction are of a special nature, and under the 2014 Constitution the legislator worked on the need for judicial authorities next to the two judicial authorities (ordinary - administrative) and deliberately jurisdiction and granted them specific jurisdiction with certain persons, and disputes whose nature differs from the nature of the dispute before the judiciary with general jurisdiction, and next to the four bodies, the legislator established exceptional bodies and committees and launched The exceptional judiciary and grant it the judicial judgment for considerations related to the public interest, and pursuant to the distribution of the jurisdiction of the judiciary between the different parties, the legislator distributes the mandate of each party to its various courts in accordance with specific rules, and to ensure the performance of justice, the state proceeds to eliminate everyone who is on its territory through the national judiciary, the jurisdiction of the judiciary, although it is regional in origin, but the legislator for special considerations makes it personal as it comes out of being subject to the jurisdiction of the judiciary some lawsuits due to their nature and the nature of the addressees from National jurisdiction, the State exercises its jurisdiction On everyone who is on its territory and on what is happening on its territory of crimes and facts as the jurisdiction of the judiciary is a manifestation of sovereignty, and therefore the jurisdiction of the judiciary in the state is determined by the limits of its sovereignty, and may be excluded from the national judiciary jurisdiction in general for multiple considerations because the dispute has a foreign element or related to an act of sovereignty or a person who enjoys judicial immunity, and if the civil judiciary has a general jurisdiction, but it is not the judiciary in the state, but shared by other parties Consequently, civil matters assigned by the legislator to other bodies may arise and therefore what falls within the jurisdiction of these bodies necessarily falls outside the jurisdiction of the civil judiciary. | ||||
